If you’re staking ETH casually or running a small setup at home, chill—you don’t need a license. But if you’re staking for others or operating on a commercial scale, that’s a different story. Businesses like those will need to register as Virtual Asset Service Providers (VASPs).
3. Do influencers, KOLs, or creators like me fall under these regulations?
You’re off the hook! Promoting crypto doesn’t make you a VASP. As long as you’re not managing wallets, transferring assets, or offering financial services, you don’t need to worry.
4. What’s the deal with penalties and fines?
Play by the rules, and you’re golden. If not:
Individuals could face fines of up to KES 10M or 10 years in jail.
Companies? KES 20M in fines.
And for daily violations? KES 3.75M per day. Yikes! So make sure you’re compliant.
5. How does this affect peer-to-peer (P2P) transactions?
Good news—P2P transactions like Bitcoin trading won’t be regulated. The law focuses on centralized players like exchanges.
